Why regulation may come for crypto - American Banker

The push toward clearer crypto regulation stems from a basic mismatch: digital assets have grown into a market of meaningful size while the rules governing them remain fragmented. In the United States, oversight is split among agencies, and it is often unclear which token or activity falls under which regime. That ambiguity creates real costs — compliance uncertainty for firms, limited investor protections, and uneven enforcement across venues.

For markets, the key question is not whether regulation arrives, but in what form. Clearer definitions of what counts as a security, how stablecoins are treated, and how exchanges and custodians must operate could reduce legal risk and make institutional participation easier to justify. Stricter rules, by contrast, could raise compliance costs and squeeze out smaller players.

What to watch: legislative proposals in Congress, agency rulemaking and enforcement actions, and how major financial institutions position themselves as the framework takes shape. Each signal matters because regulatory clarity, or its absence, shapes liquidity, market structure, and where crypto activity ultimately locates.
