Europe moves to regulate DeFi – ESMA defines what ‘genuinely decentralized’ means - AMBCrypto

The European Securities and Markets Authority (ESMA) has moved to clarify how decentralized finance (DeFi) fits within the European Union's regulatory framework. According to AMBCrypto, the regulator has set out criteria for what counts as "genuinely decentralized," a distinction that could determine whether a DeFi protocol falls under existing securities and crypto rules or sits outside them.

The development matters because DeFi's core premise — removing intermediaries — has long created a regulatory grey area. If a protocol is deemed genuinely decentralized, it may escape obligations designed for centralized operators. If it is not, those obligations could apply. ESMA's definition therefore gives market participants a reference point for assessing where a project stands.

What to watch is how these criteria are applied in practice and whether other jurisdictions adopt similar language. For now, the guidance signals that European regulators intend to engage with DeFi through defined tests rather than blanket exemptions, a shift that could shape compliance planning across the sector.
